Manual Handling Compensation Claims UK
Being involved in an accident at work can be a painful and stressful time. If you or a family member have been injured in an accident at work that was not your fault you may be entitled to make a claim for compensation.
What’s Manual Handling?
The term Manual handling can be defined as transporting or supporting of a load which includes lifting, putting down, pushing, pulling, carrying by hand or by bodily force. Over 30 per cent of all accidents that are reported to the Health and Safety Executive are associated with manual handling.
Responsibility
There are laws designed to ensure that all employers and employees take reasonable action to prevent injury as a result of manual handling under the Manual Handling Operations Regulations 1992. This particular regulation was amended in 2002. The regulation requires employers to:
- Avoid the need for hazardous manual handling so far as it is reasonable to do so, for example by redesigning the task to avoid moving the load or by automating or mechanising the process.
- Asses the risk of injury from hazardous manual handling that cannot be avoided
- Reduce the risk of any potential hazardous manual handing in the workplace, for example provide employers with mechanical assistance in the form of a hoist or sack trolley.
The amended Manual Handling Operations Regulation 1992 also stresses the employees also have duties in preventing manual handling injuries, including:
- Follow appropriate systems of work
- Make proper use of equipment provided for their safety
- Inform employers of any hazardous handling activities that have been identified
Common Injuries associated with manual handling
The most common injuries associated with manual handling include:
- Back injuries
- Hand and Arm injuries
