Uninsured and Untraced Driver Claims UK If you have had an accident involving a vehicle that has no insurance or the negligent driver does not stop at the scene of an accident you would be forgiven for thinking there is nothing that you can do. This is a common misinterpretation of the law. The Motor Insurers Bureau was set up in 1946 to help innocent parties in this position.



What is the Motor Insurers Bureau (MIB)?

The MIB was established in 1946 as a limited company to help compensate innocent accident victims of negligent uninsured and untraced drivers. Every insurer is obliged by virtue of the Road Traffic Act 1998 (LINK TO THIS?) to contribute to the MIB’s UK guarantee fund. Every driver that has an insurance policy is paying up to £30 of their premium to help compensate the innocent accident victims of uninsured driver accidents.

Claims against uninsured drivers

To make a claim for personal injury through the MIB against uninsured drivers there are some steps that you must undertake beforehand, they include;

  • Make enquiries with DVLA to see if the motorist in insured
  • Notify your insurance company that you have been involved in an accident with an uninsured driver or a driver that was not prepared to hand over insurance details. Your insurance company may be able to assist you in obtaining the relevant insurance details of the motorist
  • Collect documentation with regards to any financial loss you may have incurred as a result of the accident. This may include past pay slips to prove your lost earnings and costs of all storage and repair to your vehicle

Claims against untraced drivers

To make a claim for personal injury through the MIB against untraced drivers there are some steps that you must undertake beforehand, they include;

  • For any claim brought via the MIB you must report the incident to your local police station within 14 days of the accident
  • Make enquires to identify the motorist, this may be demonstrated in contacting the DVLA with any registration details of the vehicle involved you or a witness may have obtained. You should also attempt to identify the drivers with the assistance of the police
  • You must report the accident to your own insurance company
  • Please note that an excess of £300 will be deducted from all claims made under the untraced driver scheme
